In Pursuit of the Perseids 2024

NO CONTRIBUTION OR PURCHASE IS NECESSARY – MAKING A CONTRIBUTION OR PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING THIS GIVEAWAY.  NON-CONTRIBUTION ENTRIES AND CONTRIBUTION ENTRIES HAVE AN EQUAL CHANCE OF WINNING.

HOW TO ENTER THE ABOVE SWEEPSTAKES:
No contribution or purchase is necessary. To enter the “In Pursuit of Perseids” Giveaway (the “Giveaway”), an eligible entrant must do one of the following: 1) Join or renew a membership or make a donation to Portola and Castle Rock Foundation aka PCRF (the “SPONSOR”) between 12:00 am on April 15, 2024 and 11:59 pm on June 30, 2024 (all times PT)(“the Entry Period”), or 2) send an email with your name, phone number, postal address and email address during the Entry Period.

An eligible person will be automatically entered upon joining or renewing a membership, or making a donation to Portola and Castle Rock Foundation during the specified time period. Donations can be made online. No membership or donation is necessary to enter or win.

Complete contact information must be provided to be considered eligible, and includes: name, valid US telephone number, US Postal address and email address.

SPONSOR has sole responsibility for determining if an entry has been successfully submitted. Any entry that is not in compliance with these Official Rules may be disqualified, at the sole discretion of the SPONSOR. Incomplete entries or entries submitted by other means will not be considered. Limit one entry per household. Multiple entries, if discovered, will be disqualified. No mechanical reproductions of entries allowed.

ELIGIBILITY: Open only to legal residents of California who are 18 years of age or older at time of entry. THIS GIVEAWAY IS INTENDED FOR PLAY IN CALIFORNIA ONLY. DO NOT ENTER THIS GIVEAWAY UNLESS YOU ARE LOCATED IN CALIFORNIA AT THE TIME OF ENTRY. The following persons are not eligible: Persons who on or after JANUARY 1, 2024 were or are on THE BOARD OF DIRECTORS OF THE SPONSOR or their immediate family, or persons living in the same household. Void where prohibited by law.

GIVEAWAY DETAILS: One (1) Winner will be awarded the following: TWO (2) positions on the California State Parks Backpacking Adventure “In Pursuit of Perseids” on Saturday August 10 – Sunday August 11th, 2024. The Winner must follow all rules and regulations as set forth by California State Parks for the backpacking trip. The Winner of the Drawing will be given instructions on how to claim the prize. Winner may be required to sign and return a completed W9 and an affidavit of eligibility and liability release (and, where permitted, a publicity release) within seven (7) days of notification or prize will be forfeited and may be awarded to an alternate winner. Limit of one (1) prize per individual/household per year from Sponsor.

GIVEAWAY VALUE: $500.00 retail value

SELECTION AND NOTIFICATION OF WINNER: Every eligible entry will be included in the Giveaway. On or around one week after the applicable Entry Period closes, PCRF will select the potential winner for the Giveaway described above based on all eligible entries received during the applicable Entry Period. One (1) Winner for the drawing will be selected by a random drawing by SPONSOR. Winner will be notified by telephone or e-mail using the contact information provided in the entry. If Sponsor is unable to reach the Winner, Giveaway notification is returned as undeliverable, or the Winner is unable to acknowledge receipt of the Giveaway within five (5) days of notification, the un-awarded Giveaway will go to the first backup and subsequent backups thereof until the Giveaway is awarded. Winner must sign a release form prior to awarding of Giveaway. The Winner of the drawing will be given instructions on how to claim the prize.

Winner may be announced in multiple places including but not limited to PCRF’s website, Facebook, Instagram and other social media sites.

GENERAL: By participating in this Giveaway, participants agree to be bound by the Official Rules and by all decisions of the SPONSOR. Any person found cheating or otherwise violating the Official Rules, as determined in the sole discretion of SPONSOR, will be immediately disqualified from the Giveaway.

Participants agree that SPONSOR, and their agents have no liability whatsoever for any injuries, losses, or damages of any kind which result from use of the Giveaway, or by participation in the Giveaway.

Release of Liability: By participating, you release SPONSOR, their directors, agents, and all others associated with the development and execution of this Giveaway, from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize except as expressly set forth in these Official Rules. By entering the Sweepstakes, you further agree that: (i) any and all disputes, claims, and causes of action arising out of or in connection with the Giveaway, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

PCRF and California State Parks may use Winner’s name and likeness for advertising, fundraising, promotional or publicity purposes without further compensation.

Taxes and other expenses as a result of winning the Giveaway are the sole responsibility of the Winner.
